Terms of Use


The following is a legal software license agreement between you, the software user and IndexSkins.com.


THE SOFTWARE (INDEXSCRIPT TEMPLATE) IS LICENSED, NOT SOLD, AND AVAILABLE FOR USE ONLY UNDER THE TERMS OF THIS LICENSE AGREEMENT. PLEASE READ THIS AGREEMENT CAREFULLY. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS, DO NOT INSTALL THE SOFTWARE.


Grant of License. This license permits you to install/use the Software for FREE on multiple computers subject to the restrictions below:


Usage.
1. You may not sell, rent, lease, or sub-license the Software or portions thereof
2. Reproduce, distribute or transfer the Software without prior consent from IndexSkins.com
3. Licence holders may alter or modify the software for their own use, but may not resell, redistribute or transfer the modified, or derivative version
4. Extract sub-components from this Software to be used in other Software
5. Use the Software for sites with adult content, violence or that promote racial hatred


Copyright. The Software contained in this package is owned by IndexSkins.com and is protected by international copyright laws, international treaty provisions, and all other applicable national laws. The Software must be treated like all other copyrighted materials (e.g. books and musical recordings). This Agreement does not grant you any intellectual property rights in the Software. Licence holders must display "skinned by IndexSkins" notices on every page generated by the Software. All copyright and proprietary notices in all components of the Software must remain intact.


No Warranty. The Software is being delivered to you "AS IS". IndexSkins.com does not and cannot warrant the performance or results you may obtain by using the Software or accompanying documentation. IndexSkins.com make no warranties, express or implied, as to the non-infringement of third party rights, merchantability, or fitness for any particular purpose.


No Liability for Consequential Damages. In no event shall IndexSkins.com be liable for any damages whatsoever (including but not limited to damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) which results from an inability to use this software, even if IndexSkins.com has been advised of the possibility of such damages. YOU ASSUME ALL RISK ASSOCIATED WITH THE INSTALLATION AND USE OF THE SOFTWARE.


Indemnity. You agree to indemnify and hold harmless IndexSkins.com for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements or fees arising from your use or misuse of the Software, or a violation of any terms of this licence.


Termination. Without prejudice to any other rights, IndexSkins.com may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Software.


Restricted Rights. The Software and documentation are provided with Restricted Rights.
